1. Case Background
Recently, more and more businesses have installed CCTV cameras inside their premises to record visitors and customers. But if a person’s body is captured on CCTV during this process, does that automatically mean a violation of the Act on Special Cases Concerning the Punishment of Sexual Crimes, commonly called the Sexual Violence Punishment Act?
This issue may arise quite often in places such as hospitals. Patients and visitors may stay there for a long time, and parts of their bodies may be exposed during medical treatment, procedures, or examinations. Therefore, the installation and operation of CCTV inside a business is not only a matter of facility management or safety. In some cases, it may also become a criminal law issue.
In this case, several CCTV cameras were installed inside the hospital for patient safety and facility management purposes. However, a patient raised an issue that her body could be recorded without her consent while she was moving around inside the hospital. She argued that this recording could fall under “recording by using a camera or similar device,” which is prohibited under the Sexual Violence Punishment Act. Based on this, the patient filed a criminal complaint against the hospital director for violation of the Sexual Violence Punishment Act.
2. Relevant Law
Article 14 of the Sexual Violence Punishment Act provides that a person may be punished if he or she uses a camera or any other similar device to record another person’s body against that person’s will, where the recorded body part may cause sexual desire or sexual shame. The statutory penalty is imprisonment for up to seven years or a fine of up to KRW 50 million.
The phrase “a person’s body that may cause sexual desire or sexual shame” is not limited to certain specific body parts. Whether a body part falls under this phrase must be decided on a case-by-case basis. Relevant factors include the body part recorded, the angle of the recording, the circumstances of the recording, whether the recording was repeated, the place of recording, and the situation of the alleged victim.
In fact, there are court cases where repeated recording of a person’s legs was found to be recording of a body part that may cause sexual desire or sexual shame.
Therefore, if the CCTV footage identified by the patient shows that a specific part of the patient’s body was repeatedly recorded, the investigative authorities may examine whether the recording violates Article 14 of the Sexual Violence Punishment Act. This was also what happened in this case.
